1. About TorrentClaw
TorrentClaw ("the Service") is a search engine and metadata aggregator operated from Moldova. The Service indexes publicly available torrent metadata from third-party sources across the internet. TorrentClaw does not host, store, upload, transmit, or distribute any copyrighted content, media files, or torrent files (.torrent). The Service only displays metadata — including titles, descriptions, posters, ratings, and magnet links — sourced from public APIs and public BitTorrent DHT networks.
2. Acceptance of Terms
By accessing or using TorrentClaw, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. We reserve the right to modify these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
3. Nature of the Service
TorrentClaw functions as a search engine and index of publicly available metadata. The Service: • Does NOT host any files, media, or copyrighted content. • Does NOT upload, seed, or distribute any torrents. • Does NOT store .torrent files on its servers. • Provides magnet links that reference content available on public BitTorrent DHT networks. • Aggregates metadata from publicly accessible third-party sources. The magnet links and metadata displayed by TorrentClaw are derived from information freely available on the public internet. TorrentClaw does not control, verify, or endorse the content referenced by these links.
4. User Responsibilities
You are solely responsible for: • Ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations. • Any content you download or access through magnet links or third-party services referenced on TorrentClaw. • Verifying that you have the legal right to download or access any content before doing so. Downloading copyrighted material without authorization from the copyright holder may be illegal in your jurisdiction. TorrentClaw does not encourage, endorse, or facilitate copyright infringement.
5. No Liability for Third-Party Content
TorrentClaw does not control the content indexed from third-party sources. We make no representations or warranties regarding: • The accuracy, completeness, or legality of any metadata or content referenced by the Service. • The availability, safety, or quality of files referenced by magnet links. • The actions of third-party websites, torrent trackers, or DHT networks. TorrentClaw is not responsible for any damages arising from your use of third-party content or services referenced through the Service.
6. DMCA Compliance
TorrentClaw respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that metadata indexed on TorrentClaw infringes your copyright, you may submit a DMCA takedown notice. Upon receipt of a valid notice, we will promptly remove the identified metadata and apply noindex directives. 7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TORRENTCLAW AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: • Damages arising from the download or use of content referenced by the Service. • Damages resulting from any unauthorized access to or use of our servers. • Damages resulting from any interruption or cessation of the Service. • Damages resulting from any bugs, viruses, or malicious code transmitted through the Service. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
8. Indemnification
You agree to indemnify, defend, and hold harmless TorrentClaw, TorrentClaw, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: • Your use of the Service. • Your violation of these Terms. • Your violation of any third-party rights, including intellectual property rights. • Any content you download or access through the Service.
9. API and Integration Usage
TorrentClaw provides a public REST API and integrations with AI assistants. Use of the API is subject to these Terms and any additional API-specific terms. You agree not to: • Use the API to build competing services without authorization. • Exceed published rate limits or attempt to circumvent access controls. • Use the API for any illegal purpose or to facilitate copyright infringement. We reserve the right to revoke API access at any time without notice.
10. Account Terms
If you create an account on TorrentClaw: • You are responsible for maintaining the security of your account and password. • You are responsible for all activity that occurs under your account. • You must provide accurate information when creating your account. • We reserve the right to suspend or terminate accounts that violate these Terms.
11. Prohibited Uses
You may not use TorrentClaw to: • Violate any applicable law or regulation. • Infringe upon the intellectual property rights of others. • Distribute malware, viruses, or other harmful content. • Attempt to gain unauthorized access to the Service or its systems. • Engage in automated scraping or crawling beyond published API capabilities. • Harass, abuse, or threaten other users or Service operators.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Moldova, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts of Moldova.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
